The CFMMEU has launched legal action in the Federal Court alleging that the failure to provide a copy of a documented worksite safety management plan amounted to obstructing or hindering an Authorised Representative of a Registered Employee Organisation (ARREO). Now ,on entry an ARREO has the power to inspect plant, substance or any other thing in respect of the suspected contravention. It is the current position that that documents are not things and WorkSafe Victoria guidance confirms that an ARREO does NOT have the power to require a person to produce documents. In addition documents may be subject to privacy considerations, commercial in confidence restrictions and intellectual property rights. Not sure this is going to fly….. Watch this space.
